Instantly after the National Council of Justice (CNJ) prohibited courts in the country from granting new benefits and financial advantages to members of the Judiciary through administrative decisions on Tuesday (20), the Federal Public Ministry (MPF) took the opposite direction and recognized retroactive labor benefits to prosecutors, dating back more than ten years, starting from January 2015. The Vice-Prosecutor General of the Republic, Hindenburgo Chateaubriand Filho, complied with a request made by associations representing the careers of the Federal Public Ministry - prosecutors of Labor, Military Public Ministry, Public Ministry of the Federal District and Territories, and the MPF itself. The request sought the right to compensatory leave for prosecutors with a accumulation of workload. This benefit guarantees the payment of an extra day of work for every three days worked by prosecutors who faced excessive workload during the period. In practice, the values are expected to exceed R$ 1 million to be paid to each prosecutor. As this is considered an indemnity, the payment is outside the calculation of the salary ceiling of the public service. The recognition of these retroactive values is one of the most common "penduricalços" in the composition of supersalaries in the legal careers. In the case of the Judiciary, however, a decision signed by the President of the CNJ and the STF (Supreme Federal Court), Minister Luís Roberto Barroso, and the National Corregidor of Justice, Minister Mauro Campbell Marques, barred the granting of these payments through administrative means. The decision determines that the recognition of rights of this nature can only occur after the judgment of collective lawsuits or based on precedents qualified by superior courts. Barroso's electronic signature was registered at 14:46. The measure only applies to the Judiciary careers. Meanwhile, the decision of the Vice-Prosecutor General, which authorized the payment of benefits to MPF members, was signed at 16:24. As a result, the right to payment was recognized before any potential manifestation of the National Council of the Public Ministry in a similar sense to the CNJ.
