The notice states that existing rules and regulations apply to entrepreneurs, legal professionals, and other stakeholders who incorporate AI into their work. The guidance covers scenarios such as using AI software for document drafting, AI tools usage disclosure duties, and properly filing or submitting documents to the USPTO. The provisions in the guidance were developed based on stakeholder engagement and a review of existing rules. The notice emphasizes the risks involved in utilizing AI systems, including cybersecurity and data privacy. Violations of USPTO rules through improper use of AI systems could result in penalties or liabilities, including revocation of a user's USPTO.gov account. The notice follows the USPTO's February guidance on AI-assisted innovations submitted for patents, as required by President Joe Biden's 2023 Executive Order on AI.
