【评论|男孩超市奔跑致营业员摔伤 家长赔11万冤吗】广东惠州市惠城区一家超市新开业，住在该小区的赵女士带12岁的儿子去逛超市，意外就这么发生了。她的儿子在超市遇到同小区玩伴，两人在货架之间奔跑嬉闹，导致刚上班第一天的营业员谢女士摔倒受伤。后者将超市与赵女士夫妇告上法庭，法院判赵女士判赔11万元，网友纷纷叫好，说是阳光判决。
营业员谢女士头天上班，就遇到赵女士在超市内奔跑的儿子，导致左上臂骨折，伤残十级，对应共18.58万元的赔偿金额，法院判赵女士承担六成，超市承担三成，这让赵女士觉得很不公平。在中国新闻周刊6月12日的报道中，她转述儿子的话说他没碰着谢女士，是后者自己爬起来的，而且谢女士端着水在超市行走时东张西望，疏于观察前方环境，导致其主动踩上正在通道前方的小孩——也就是说，是她自己没注意才导致摔倒。
在赵女士看来，孩子是有责任，但她只愿意承担10%以内的责任。但一审法院显然不这么看，更认为一切肇始于男孩的追逐打闹，即便谢女士没有尽到注意义务，相比之下，责任也是很轻微的；超市承担谢女士三成的人身伤害赔偿，是因为没有尽到公共场所安全保障的义务。
赵女士一审没请律师，在一审判赔11万后要请律师上诉，二审会不会维持一审的判决，值得关注。
该判决之所以被夸赞，是网友觉得法官没有打着保护未成年人利益的旗号折损法律，而是让监护人掏11万元为孩子的不当行为埋单。很多人非常厌恶小孩在超市、列车、商场、餐馆这些公共场合打闹嬉戏，一些父母却不管不顾，或者轻描淡写没有管束，在网友眼里，这11万相当于是放纵熊孩子的代价。
一审的判决和网友几乎一边倒的态度，提醒很多家长：不要以为孩子犯错天然就该得到谅解，未成年人就该得到照顾，法院不会纵容这种惯性思维。
