A Primeira Turma do Supremo Tribunal Federal (STF) formou maioria nesta terça-feira, 10, para manter a condenação de 14 anos de prisão imposta à cabeleireira Débora Rodrigues dos Santos, de Paulínia (SP).
Conhecida como "Débora do Batom", a ré foi denunciada por participação nos atos de 8 de janeiro de 2023, durante os quais pichou com batom a frase “Perdeu, mané” na escultura “A Justiça”, situada em frente à sede do Supremo, em Brasília.
O julgamento ocorre no plenário virtual da Corte, onde os ministros depositam seus votos eletronicamente, sem debate oral. Até o momento, o relator, ministro Alexandre de Moraes, foi acompanhado pelos ministros Cármen Lúcia e Cristiano Zanin, com maioria entre os cinco integrantes da turma. Restam ainda os votos de Luiz Fux e Flávio Dino.

Débora foi condenada, em abril, por cinco crimes: deterioração de patrimônio tombado, dano qualificado, golpe de Estado, abolição violenta do Estado Democrático de Direito e associação criminosa armada. A sentença prevê ainda o pagamento de multa no valor de R$ 50 mil. A Procuradoria-Geral da República (PGR) sustentou que a participação da ré no movimento foi ativa.
Segundo a acusação, “inflada pelos demais, praticou os atos de depredação, e somente se retirou do local após a chegada da polícia para contenção dos invasores que intentavam o golpe de Estado e a abolição violenta do Estado Democrático de Direito, por inconformismo com o resultado das eleições presidenciais de 2022”.
No recurso apresentado à Corte, a defesa de Débora alegou que o julgamento desconsiderou a confissão da acusada, o que, segundo o Código Penal, deveria ser considerado atenuante para a fixação da pena.

Os advogados também solicitaram que ela pudesse cumprir a pena em regime semiaberto e argumentaram que a ré já ficou dois anos e 11 dias em prisão preventiva, transferida para o regime domiciliar apenas no final de março deste ano. Moraes rejeitou os argumentos e afirmou que os embargos de declaração não podem ser utilizados para rediscutir o mérito da decisão.

Durante a tramitação do processo, a defesa anexou uma carta escrita por Débora e endereçada ao ministro Moraes, na qual ela pede desculpas e afirma que desconhecia o valor simbólico da escultura. A estátua "A Justiça" é tombada pelo patrimônio histórico e fica localizada em frente ao plenário do Supremo Tribunal Federal.

Love this input. I wonder what happens when these people are out of jobs at zombie companies. No longer distracted at their fiat farms, will they realize their potential to contribute to human flourishing and productivity in some other way in order to survive in the new v4v economy?
The context for the question was curiosity of what people envision when they say “bright orange future”. How do cities look? How is society different? How do we interact with each other? Those sorts of things.
