【评论| #未告知婚检结果致男方患HIV ？别把烫手山芋丢给医生】近日，湖北某医院一名妇产科主治医生在社交平台发文表示，由于婚检结果涉及患者隐私，无论是否告知患者的另一半，医生都被坑惨了。这位医生举了2个情况完全不同、结果却都是医生被停职的例子。婚检时有两位被查出患有艾滋病的女孩子，其中一位女孩不让医生和疾控中心告诉她的结婚对象，导致男方得了艾滋病，在被投诉后，涉事医生被停职待业；第二个女孩，医生告诉了她对象实情，两人没结婚，女孩投诉医生后，医生被停职三个月后辞职。
这个帖子的真实性有待证实，但引发了医生群体的共鸣。评论区，不少医生感叹，不告知，良心上过意不去；如果患者本人极力反对，甚至用语言威胁的情况下，医生往往多一事不如少一事。而不管是否告知患者配偶或性伴侣，医生都可能被投诉，为了避免事情闹大，一些地方的相关部门就把接诊医生推出来敷衍了事。
事实上，造成医生困境的根本原因，是目前的法律法规普遍没有赋予医生告知感染者伴侣的权利；在感染者隐私权和伴侣健康权面前，法律更保护前者。比如，《侵权责任法》第六十二条规定，医疗机构及其医务人员应当对患者的隐私保密。泄露患者隐私或者未经患者同意公开其病历资料，造成患者损害的，应当承担侵权责任。
《艾滋病防治条例》同样规定，未经本人或其监护人同意，任何单位和个人不得公开艾滋病病毒感染者、艾滋病病人及其家属的姓名、住址等以及其他可能推断出其具体身份的信息。
这些法律条文都是为了保护患者的隐私权，让他们能正常生活，避免被人歧视。但令人无奈的是，现实中它们却成了一些HIV患者向结婚对象或者发生性关系的人隐瞒的“盾牌”。
虽然《民法典》规定，一方患有重大疾病的，应当在结婚登记前如实告知另一方；不如实告知的，另一方可以向人民法院请求撤销婚姻。但这种事后的救济，无法阻止伴侣感染艾滋病。《艾滋病防治条例规定》，艾滋病病毒感染者和病人有义务将感染事实告知与其有性关系者。如果不告知要承担怎样的法律责任，条例并没有详细说明。
患者的隐私权当然要保护，但是保护患者配偶或者性伴侣的知情权、人身健康权同样重要。与其让医生背负沉重的道德责任，努力去做患者的思想工作，在违规的边缘试探，不如赋予医疗机构主动告知伴侣的权利，同时用法律手段倒逼患者如实向另一半披露感染情况。关于知情权和隐私权的争论持续了很多年，在无辜者的健康面前，哪个更为优先，并不难判断，是时候有个统一结论了。 #洞见计划 :sys_link: 网页链接 https://www.sohu.com/a/902764185_121899824
