Uma investigação do Ministério Público apontam supostas irregularidades envolvendo o ex-diretor da Associação de Proteção e Assistência ao Condenado (APAC) de Passo Fundo, Vinícius Toazza, e ao menos um ex-funcionário do local, entre elas, uma suposta distribuição de celulares a detentos de presídios da Região Norte do RS.

Ambos foram denunciados pelo esquema, que ainda envolveria o acobertamento de fugas de detentos e a manutenção de um grupo com os apenados, em que repassariam informações sigilosas. Os detalhes estão na denúncia entregue pelo MP ao Judiciário em dezembro, à qual a reportagem da RBS TV teve acesso.
A Apac consiste em um sistema de encarceramento diferente do tradicional: a proposta é que os apenados tenham corresponsabilidade pela sua recuperação em um ambiente com acesso à profissionalização, educação, saúde e religião. Em Passo Fundo, a entidade civil de direito privado foi inaugurada em março de 2023.
Celulares nos presídios
A investigação apontou um esquema que envolveria a entrega de celulares para apenados que estavam em presídios da região. Conforme a denúncia do MP, um funcionário da Apac identificado como William Soares Rangel seria o responsável por essa função.
"Um representante da Apac se apresentava como uma espécie de delegado do Poder Judiciário, do Ministério Público, e assim tinha acesso ao anterior estabelecimento prisional, onde mantinha contato com os apenados e repassava aparelhos de telefone e celular", relatou o promotor à frente da operação, Diego Pessi.
A apuração identificou que, em 15 de fevereiro de 2024, Rangel teria ido até o Presídio de Erechim, onde teria se apresentado como funcionário da Apac e informado que precisaria realizar entrevista com presos candidatos a ingressar na instituição. Segundo um relato presente na denúncia, William teria dito que havia cobrança do MP e do Judiciário para que novos apenados fossem selecionados.
Após a conversa com um preso, que teria sido revistado antes de entrar na sala, houve novamente fiscalização e, desta vez, os agentes encontraram um celular com sete chips. O Ministério Público, então, cumpriu mandado de busca e apreensão na casa de William, onde encontrou sete celulares, outros eletrônicos e documentos.
Em meio aos documentos havia um contrato de empréstimo entre Vinicius e William com valor de quase R$ 80 mil. Outro papel é uma lista com nomes de apenados candidatos a entrarem na Apac.
A extração de dados de um dos celulares apreendidos mostrou uma conversa que seria de William com uma pessoa cujo contato foi salvo como "mcc". Este último cobra uma resposta do "Mestre", codinome supostamente usado por Toazza, segundo o MP.
William responde que o "Mestre" responderia sobre o assunto pessoalmente a ele quando se encontrassem na Apac. "É que mensagem fica como prova né. Por isso ele te ligou aquele dia", teria escrito.
Em outra conversa que seria de William e uma mulher, ele relata que no dia 17 de março de 2024 teria sido demitido da Apac e, por isso, precisava de auxílio financeiro para pagar contas. Na conversa, Rangel teria relatado que foi demitido como uma forma de "queima de arquivo" para compensar erros antigos aos quais supostamente atribuiu ao então diretor.

Fugas seriam acobertadas
O MP encontrou, através de extração de dados de celulares apreendidos na investigação, mensagens que reforçam a suspeita de que as fugas eram conhecidas e acobertadas.
Na noite de 13 de setembro de 2023, quando dois detentos fugiram da Apac, o então diretor da instituição, Vinícius Toazza, teria sido alertado sobre o caso através de uma mensagem supostamente enviada por Wagner Morais Rodrigues, apenado na instituição que não poderia ter celular.
Na ocasião, Vinícius teria dito que, se os apenados voltassem, ele resolveria a situação. Diria que o portão ficou aberto e após a dupla discutir, saíram da casa.
Já sobre outra fuga, descoberta em outubro de 2023, a 6ª Promotoria Criminal de Passo Fundo disse ao Gaeco que não foi informada pela direção da Apac "passados quase dois meses" da saída irregular.
Em outra ocasião, registrada em 24 de julho de 2023, um apenado da Apac envia uma mensagem no grupo "OsGuriDaPaC" informando que não está presente por motivos pessoais. Toazza teria demonstrado saber da ausência e respondido: "O que precisar estou aqui".
Comunicação entre a direção e os apenados
Em maio de 2024, o Ministério Público cumpriu mandados de busca e apreensão no Presídio de Erechim, onde 11 celulares foram recolhidos pelo Gaeco. A extração de dados dos aparelhos mostrou a existência de um grupo de WhatsApp chamado "OsGurisDaPaC". Entre os integrantes estariam Vinícius e os apenados.
Foi neste grupo que, apontou a investigação, Toazza alertou sobre a chegada do superintendente na unidade em 28 de fevereiro de 2023. Na mensagem, ordenou que os celulares fossem escondidos.
Sobre isso, o promotor Diego Pessi falou:
"A investigação aponta a existência e a utilização desse grupo, inclusive para que se burlasse a fiscalização que deveria ocorrer na Apac, como avisar para que se escondessem aparelhos de celular. Uma série de irregularidades foram verificadas e, entre elas, essa utilização indevida de aparelhos de telefone".
O grupo "OsGuriDaPaC" também serviria para circular informações sobre o que acontecia em penitenciárias. Em 2023, quando detentos planejavam uma greve geral no Estado, Toazza teria pedido sobre a adesão. "Os nossos aderiram à greve?", questionou no grupo.
Entre as conversas presentes nos celulares, o Gaeco encontrou o que seria uma troca de mensagens entre Vinicius e o apenado Wagner no dia 15 de dezembro de 2023. O apenado reclama de uma decisão de um juiz e afirma que sua vontade era matá-lo.

A denúncia do MP
Depois das apreensões de celulares e documentos nas ações de 2024, o Ministério Público encaminhou a denúncia à Justiça em dezembro do ano passado e solicitou a prisão preventiva dos seguintes investigados:
Vinícius Toazza, ex-diretor da Apac
William Soares Rangel, ex-funcionário da Apac
Maria Isabel Soares, mãe de Rangel
Mateus de Almeida Riva, ex-apenado da Apac e hoje preso
Eduardo Abreu Nunes, ex-apenado da Apac e hoje preso
Dionatan Bento dos Santos, ex-apenado da Apac e hoje preso
Wagner Morais Rodrigues, ex-apenado da Apac e hoje preso.
O Judiciário aceitou o pedido no dia 10 de abril de 2025. Todos tiveram as prisões decretadas, exceto a mãe de William, também suspeita de envolvimento no caso, que recebeu medidas cautelares.
As ordens foram cumpridas no dia seguinte. William e Vinicius foram presos, enquanto os ex-apenados já estavam cumprindo penas em casas prisionais do estado.
Cerca de 10 dias após as prisões, tanto William quanto Vinícius foram liberados através de habeas corpus solicitados por seus advogados, José Paulo Schneider e Vicente Teston, respectivamente. Os advogados relataram a falta de contemporaneidade entre as ações do MP ao longo de 2024 e as prisões já no segundo trimestre de 2025. A Justiça acatou os pedidos e os dois respondem o processo em liberdade.
O que dizem as defesas
Em entrevista à RBS TV, José Paulo Schneider, que defende William e sua mãe, relatou que ainda colhe informações e provas para defesa. A defesa de cada um será feita de formas diferentes.
"Em relação a Maria Isabel, estamos juntando documentos para comprovar a licitude das movimentações financeiras que o Ministério Público apontou como ilícitas. Já temos toda a documentação e, em momento oportuno, vamos juntar para demonstrar a licitude dessas movimentações", afirmou Schneider.
"Em relação a William, o mérito já é um pouco mais robusto e vamos reservar ao momento da instrução. O que é importante destacar desde já é que ele apresenta um histórico de vício em apostas que vai interferir diretamente no motivo dessa movimentação e condutas que ele tomou", completou o advogado.
Procurada, a defesa de Vinícius Toazza, representada pelo advogado Vicente Teston, apontou que busca preservar o cliente e vai se manifestar nos autos do processo.

Here is how it works:
1. The receiver sets up their wallet and chooses a mint (this is done while online). The wallet will download the mint’s key sets and save them locally
2. When the receiver wants to receive a payment (now being offline) the wallet will generate a payment request, specifying the amount, the locking script, and the mint.
3. The sender scans the payment request and constructs the requested token
4. The receiver receives the token. His wallet checks whether the token fulfils the requirements. Then it uses the included DLEQ proofs and the cached key set to verify whether the signature on the token is valid. If it is, the transaction is complete.
