Deputado Mendonça Filho criticou proposta do governo Lula, principalmente em relação à possibilidade deixar a cargo da União a criação de leis sobre sistema penitenciário. Relator do caso, o deputado Mendonça Filho (União-PE) chegou a um acordo com o governo sobre carga horária de matérias obrigatórias.

O deputado Mendonça Filho (União-PE), relator da PEC da Segurança na Câmara, disse ser contrário à ideia de dar à União a competência privativa para legislar sobre o sistema de segurança pública – atualmente, estados e municípios têm autonomia em relação ao comando das polícias.
O parlamentar participou de uma audiência na Câmara a Proposta de Emenda à Constituição (PEC) enviada pelo governo ao Legislativo em abril.
A declaração foi dada na presença do ministro da Justiça, Ricardo Lewandowski, que defendeu a aprovação da proposta.
"Não concebo e imagino que você possa combater o crime organizado a partir de Brasília", disse o deputado. "A gente imagina que todos os problemas do Brasil vão ser resolvidos em Brasília e por Brasília, quando na verdade a ação básica que atende a população está na ponta", completou.
Durante a audiência, o ministro Lewandowski disse que a proposta não fere a Constituição uma vez que não vai contra nenhuma de suas cláusulas pétreas.
Lewandowski defendeu que a Constituição permite competências privativas e comuns entre os três poderes e defendeu um "federalismo cooperativo", com isso seria possível melhor coordenação e padronização de procedimentos.
"Penso que não há nenhuma inconstitucionalidade, temos que pensar o federalismo nas cláusulas pétreas sob o viés do federalismo cooperativo", disse o ministro.
Ele ainda destacou que o Sistema Único de Segurança Pública já está previsto em lei, aprovada em 2018 pelo Congresso, e o projeto apenas o incorpora à Constituição. O projeto está em análise na Câmara e, caso aprovado, ainda será encaminhado ao Senado.
Críticas
A oposição defendeu a inconstitucionalidade da proposta. "Ela fere o pacto federativo", disse o deputado Carlos Jordy (PL-RJ).
"O governo diz que a solução para a segurança pública é retirar a autonomia dos estados e concentrar no governo federal. O que o governo está dizendo é: governadores e policiais estaduais são um fracasso", acrescentou Jordy.
