The majority of the ministers voted to overturn a temporary decision made by Minister Flávio Dino, which had reinstated the effects of the rule. The trial is being held virtually since last Friday, the 13th, and will continue until the 24th. The action was brought by the Brazilian Association of Telecommunications Infrastructure (Abrintel) against a 2021 law that repealed the obligation to share, which had been in place since 2009. Until 2021, towers had to be shared between telecommunications service providers whenever the distance between the stations was less than 500 meters. The device that eliminated the obligation to share towers was inserted through an "amendment" in a bill unrelated to the subject. According to Dino, this type of amendment hinders the due process of law and the democratic principle. He was joined by Minister Dias Toffoli.
